First Solar has submitted a patent infringement claim against Jinkosolar, related to a Topcon patent that owns first solar energy due to a business recruitment from 12 years ago. First solar energy submitted to the American court for the Delaware district.
First Solar owns the American patent no. 9,130.074, which includes the production methods for Topcon Silicon solar cells. First Solar, a manufacturer of a thin film solar panel, obtained the Silicon patent due to the acquisition of Tetrasun 2013. The patent is valid via at least 2030.
“We have been clear that we will actively defend our intellectual property rights in the US and actively. Unfortunately, our interaction with Jinkosolar is unproductive and we have left no other choice than to enforce our patent rights by legal steps, ”said Jason Dymbort, vice -president, general counsel and secretary of First Solar. “Given the answers we have received from other manufacturers of solar cells in connection with our infringement research, we believe that we have a strong Portent portfolio from Topcon Technology. We expect that our lawsuit against Jinkosolar will repeat the need for topcon manufacturers of solar cells to operate within the well-defined framework of intellectual property rights. “
Manufacturers of solar panels are currently in a maze of Topcon patent fights, in which most major players complained or are being charged. This is the first patent claim of First Solar, although the company has pointed to more authorities.
